MINUTES JUNE 29, 2006 SPECIAL MEETING

        A Special Meeting of the City Council was held in the Council Chamber on Thursday, June 29, 2006 at 10:24 P.M. for the purpose of adoption of Re-organizational Ordinances for second and final passage.  Notice of this meeting was posted on June 26, 2006 at 9:59 A.M.

        All Councillors present

        
Council President Jean Pelletier presided.


Councillor Veno moved to dispense with the reading of the record of the previous meeting. It was so voted.


        Councillor O’Leary assumed the chair.


#517- (#271) – ORDINANCE AMENDING INSPECTOR OF ANIMALS


Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee of the Whole to whom was referred the matter of an Ordinance amending Chapter 8, Section 1, Appointment of Inspector of Animals, has considered said matter and would recommend that it be adopted for second and final passage.


#518 – (#272) – ORDINANCE AMENDING HARBORMASTER’S APPOINTMENT, TERM, POWER AND DUTIES

Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report.

Amendment to add “The compensation of the Harbormaster shall be fixed by the Mayor under collective bargaining agreement”. The amendment was adopted.

The Committee of the Whole to whom was referred the matter of an Ordinance amending Chapter 10, Section 4, Harbormaster’s Appointment, Term, Power and Duties, has considered said matter and would recommend that it be adopted for second and final passage as amended.

#519 – (#274) – ORDINANCE AMENDING POWERS AND DUTIES OF THE FINANCE DEPARTMENT

Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee of the Whole to whom was referred the matter of an Ordinance amending Chapter 2, Section 494, Powers and Duties of Finance Department, has considered said matter and would recommend that it be adopted for second and final passage.


#520 – (#275) – ORDINANCE AMENDING STAFF SUPPORT TO THE APPEALS BOARD

Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report.

Amendment to add the words “upon request” in the first sentence following staff assistance to the appeals board.

The Committee of the Whole to whom was referred the matter of an Ordinance amending Chapter 2, Section 114, Staff Support to the Appeals Board, has considered said matter and would recommend that it be adopted for second and final passage as amended.


#521 – (#276) – ORDINANCE AMENDING COUNCIL ON AGING EXECUTIVE DIRECTOR

        Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee of the Whole to whom was referred the matter of an Ordinance amending Chapter 2, Section 836, Council on Aging Executive Director, has considered said matter and would recommend that it be referred to the Committee on Ordinances, Licenses and Legal Affairs.

Councillor O’Keefe was recorded as opposed.





#522 – (#277) – ORDINANCE AMENDING DIRECTOR OF HEALTH AND INSPECTIONAL SERVICES

Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report.

        Amendment – (a) insert after the Mayor shall appoint, “subject to confirmation by the City Council. The amendment was adopted.

        Amendment – delete “Health” in the title to read as “Director of Inspectional Services. The amendment was adopted.

        Amendment – add (d) “The Director of Inspectional Services shall receive compensation as the City Council shall prescribe”. The amendment was adopted.

        Amendment – add (e) “The Health Agent shall continue to be appointed by and responsible to the Board of Health”. The amendment was adopted.

        Amendment – add (f) “The Department of Health will cooperate and coordinate with the Director of Inspectional Services” and delete the word “Health” from section (b). The amendment was adopted.

        The Committee of the Whole to whom was referred the matter of an Ordinance amending Chapter 2, Section 115, Director of Health and Inspectional Services, has considered said matter and would recommend that the Ordinance be adopted as amended for second and final passage. It was adopted as amended for second and final passage by roll call vote of 6 yeas, 5 nays, 0 absent. Councillors Blair, Corchado, O’Leary, Prevey, Sosnowski and Veno were recorded as voting in the affirmative. Councillors Furey, Lovely, O’Keefe, Sargent and Pelletier were recorded as voting in the negative.

Councillor Blair moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.


#523 – (#278) – ORDINANCE AMENDING DEPARTMENT OF PUBLIC WORKS, ENGINEERING SERVICES

Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee of the Whole to whom was referred the matter of an Ordinance amending Chapter 2, Article V, Department of Public Works, Engineering Services, has considered said matter and would recommend that it be adopted for second and final passage.


#524 – (#279) – ORDINANCE AMENDING RENUMBERING OF ARTICLE VI TO ARTICLE VII


Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report.

        Amendment – Section 2-1066 (c) add “remain at the direction of the Park and Recreation Commission. The amendment was adopted.

        Amendment – Section 2-1069
(i)     The director of public services shall coordinate and direct the care and maintenance of open space / passive recreational areas such as boulevards, walkways, the downtown and other open space areas throughout the city.

(j)     The director of public services shall be responsible to the Park and Recreation Commission and perform various duties as the Park and Recreation Commission may determine in the management, care and maintenance of recreational areas including recreational facilities such as ball fields and playgrounds and parkland.

(k)     Previous (j) now (k) as follows: The director of public services shall, with the assistance of the city’s building inspector, coordinate and direct the care and maintenance of public buildings.

The amendments were adopted.

Amendment – Section 2-1108 add (6) Compensation: The Assistant Director of Public Services shall receive compensation, as the City Council shall prescribe.
The amendment was adopted.

The Committee of the Whole to whom was referred the matter of amending an Ordinance relative to Chapter 2, Article VI, by renumbering it as Article VII, has considered said matter and would recommend that it be adopted as amended for second and final passage. It was so voted.










#525 – (#280) – ORDINANCE AMENDING PUBLIC PROPERTY

Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report.

Amendment – Section 2-1571 (e) delete all city documents and insert all documents in the jurisdiction of the City. The amendment was adopted.

Amendment – delete (i) in its entirety and rename it (j). The amendment was adopted.

The Committee of the Whole to whom was referred the matter of amending and Ordinance relative to Chapter 2, Article IX, Public Property and Section 2-1571, Responsibilities, has considered said matter and would recommend adoption as amended for second and final passage. It was so voted.


#526 – (#273) – ORDINANCE AMENDING COMPOSITION OF THE POLICE DEPARTMENT

Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee of the Whole to whom was referred the matter of an Ordinance amending Chapter 31, Section 32-1(b), Composition of the Police Department, has considered said matter and would recommend that it be adopted for second and final passage.


#527 – (#281) – ORDINANCE AMENDING DEPARTMENT OF RECREATION AND COMMUNITY SERVICE

Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee of the Whole to whom was referred the matter of an Ordinance amending Chapter 2, Article III, Division 12, Department of Recreation and Community Service, has considered said matter and would recommend that it be referred to the Committee on Ordinances, Licenses and Legal Affairs.

Councillor O’Keefe, Pelletier and Furey were recorded as opposed.



#528 – (#282) – ORDINANCE AMENDING PARKS AND RECREATION

Councillor Pelletier offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee of the Whole to whom was referred the matter of an Ordinance amending Chapter 26, Parks and Recreation, has considered said matter and would recommend that it be referred to the Committee on Ordinances, Licenses and Legal Affairs.

Councillor O’Keefe, Pelletier and Furey were recorded as opposed.


On the motion of Councillor O’Keefe the meeting adjourned at 10:50 P.M.
